This application under Article 227 of the Constitution of India is at the instance of the complainant praying for a direction upon the Municipal Building Tribunal, Kolkata Municipal Corporation to dispose of the appeal no.74 of 2023 expeditiously.
The learned advocate appearing for the petitioner submits that the hearing of the appeal is being adjourned from time to time as the case records have not yet reached the Tribunal.
In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties. However, the learned advocate appearing for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing them before the Municipal Building Tribunal.
From the order-sheets appended to the revisional application, this Court finds that June 16, 2025 has been fixed for receiving the case records.
Learned Municipal Building Tribunal, Kolkata Municipal Corporation is directed to ensure that the case records reaches the Tribunal on or before June 16, 2025. The concerned authority of the Kolkata Municipal Corporation is also directed to ensure that the case records reaches the Municipal Building Tribunal at the earliest.
C. O. No. 1619 of 2025 stands disposed of by requesting the Municipal Building Tribunal, Kolkata Municipal Corporation to take up the hearing of the appeal no.74 of 2023 immediately after the records reach the Tribunal and to make an endeavour to see that the said appeal is disposed of as expeditiously as possible but preferably by the end of December, 2025, without granting any unnecessary adjournment to either of the parties.
The learned advocate appearing for the petitioner is directed to communicate this order to the Municipal Building Tribunal and the Kolkata Municipal Corporation.
Urgent photostat certified copy of this order, if applied for, be supplied expeditiously after compliance with all the necessary formalities.
