Report submitted by the State is taken on record. The petitioner is in custody for more than 200 days and prays for bail. Learned counsel for the petitioner submits that the petitioner was in Beur Jail, Patna in connection with another case when the alleged incident occurred. He has no connection whatsoever with the alleged incident.
Learned counsel for the State opposes the prayer. It appears that the petitioner was in custody in Beur Jail, Patna when the alleged incident occurred. His name has transpired from the statement of a co-accused which is a weak piece of evidence. The petitioner appears to have criminal antecedents to his credit but there being no other prima facie material on record connecting the petitioner to the alleged offence, this Court is of the view that further detention of the petitioner is not required and he may be granted bail subject to stringent conditions. Accordingly, the prayer for bail is allowed.
The petitioner namely Shashank Singh @ Sonu Rajput be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Uttar Dinajpur, Raiganj, subject to condition that he shall appear before the learned trial Court on every date of hearing and shall not intimidate witnesses or tamper with evidence in any manner whatsoever.
In the event the petitioner fails to appear before the learned trial Court on any date without any justifiable cause, the learned trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
The application for bail is disposed of.
