Learned advocate appearing for the petitioner at the inception submits that the prayer for bail of co-accused was rejected on 13.03.2026 by the Hon'ble Supreme Court. However, the present petitioner did not approach the Hon'ble Supreme Court. There has been subsequent change of circumstances and two of the seizure list witnesses who have been examined have been declared hostile by the prosecution. Learned advocate proceed to submit that the alleged recovery in the present case is 275 grams of heroin. Apart from the same, learned advocate draws the attention to the Chemical Examiner's report.

Learned advocate appearing for the State opposes the prayer for bail.

Having considered that 13 more witnesses are yet to be examined and the present case is covered by Sentu Seikh -Vs. -

State of West Bengal [SLP (Crl.) No. 13987 of 2025], I am inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed.

As such, the petitioner, namely, Injamul Hoque shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court (under NDPS Act), 2nd Court, Berhampore, Murshidabad.

If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of district of Murshidabad without prior permission of the learned Special Court.

Thus, CRM (NDPS) No. 947 of 2026 is allowed.
