Petitioner is aggrieved by the fact that in spite of setting the law into motion in connection with Bongaon PS Case No. 895/2024 dated 26.09.2024 the petitioner has been kept in the dark and no information has been furnished to him. State has submitted a report. Report reflects that final report has been submitted as 'mistake of fact' on or about 28.01.2025. Petitioner complains that in spite of being the defacto complainant till date he has not been served with a notice. In case the jurisdictional Magistrate has accepted the report also and the petitioner was not granted any opportunity to ventilate his grievance under the relevant provisions of Section 173(8) of the Cr.P.C. or Section 193(9) of the BNSS, learned

Magistrate would grant the petitioner an opportunity to ventilate his grievance.

With the aforesaid observations WPA 10288 of 2025 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
