This is an application under Article 226 of the Constitution of India praying for a direction upon the respondent authorities to forthwith give appointment of a fair price shop dealership in favour of the petitioner in the area Beara, P.S. Bagdah, District North 24-Parganas in terms of the recommendation report submitted by the Inspection Authorities. Learned counsel appearing o behalf of the petitioner submits as follows. The petitioner had applied for the dealership of an FPS in question. An enquiry was done. As per instruction, a recommendation was also made for the petitioner's candidature. Yet, till date no decision has been forwarded to the petitioner in this regard. The petitioner has made a representation before the respondent authorities in this regard. The same has not been answered.

Learned counsel for the State submits as follows. Upon instruction, it is submitted that no final decision has been taken by the respondents in respect of the vacancy notification in question. It is disputed that any recommendation was made in favour of the present petitioner.

I have heard the submissions of the learned counsel for the parties and have perused the revision petition. It appears that no final decision has been taken in respect of the vacancy notification for FPS dealer for which the petitioner had applied. Therefore, there is no question of intimating the result as yet.

In view of the same, the writ petition is disposed of with a direction upon the respondent authorities to take appropriate steps regarding appointment of FPS dealership as expeditiously as possible and in accordance with law.

There shall be no order as to costs.
