Learned counsel appearing on behalf of the appellant submits that the appellant does not want to proceed further with the appeal as the matter has been settled between the parties out of court.

Accordingly, SA 295 of 2005 along with connected applications, if any, is dismissed for non-prosecution. Interim order, if any, stands vacated.

Department is directed to send the lower courts record, if arrived, along with a copy of this order to the court below at once.
