The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite party, as such, service of notice of the present application upon the said opposite party is dispensed with. The petitioner of the instant application under Article 227 of the Constitution of India is the plaintiff of a Money Suit being Money Suit No.61 of 2020, pending before the 3rd Court of learned Civil Judge, (Senior Division) at Howrah.

The suit was heard ex parte and was fixed for delivery of judgment on September 08, 2023.

The grievance of the petitioner is that, till date, the said judgment has not been delivered.

Mr. Dash, learned advocate for the petitioner submits that September 25, 2024 is the next date fixed for delivery of such judgment. The learned Trial Judge is requested to make all endeavour for delivery of the said judgment on the said date. C.O. 1421 of 2024 is disposed of with the above terms without any order as to costs.

The petitioner shall communicate this order to the Court below. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
