The present revisional application has been preferred challenging the order passed in Misc. Execution Case No. 48 of 2023 passed by the learned Judicial Magistrate, 2nd court, Asansol. The application in the execution case reflects there were dues of Rs.72,000/- at the time when it was preferred. Learned advocate for the petitioner by drawing the attention of this court in respect of the time period which has passed after the execution case was filed submitted that distress warrant is issued by the court for non-payment of the amount. In case the petitioner within 21st July, 2023 deposits a sum of Rs.36,000/- before the learned Judicial Magistrate, 2nd court, Asansol, the learned court would keep such distress warrant in abeyance. The learned executing court thereafter would grant four installments to repay/clear the rest of the arrears within four months. However, the regular monthly payments would be continued to be paid by the petitioner and this court has not interfered so far as the same is concerned.

With the aforesaid observations, the present revisional

application being CRR 1568 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court.
