I do not find from the records of the case that such application was preferred before the ld. ACMM, Calcutta. Having considered the same, I am of the view that until and unless the original court has dealt with the issue relating to the vehicle, this court will not exercise its discretion to interfere with the proceedings. With the aforesaid observations, CRR 1660 of 2024 is disposed of.
