None appears on behalf of the petitioner.

Learned advocate appearing on behalf of the State submits that the investigation of the case is in progress and the materials which has surfaced in course of investigation do indicate thick complicity of the present petitioner.

Learned advocate for the State at this stage opposes the prayer advanced on behalf of the petitioner for quashing of the proceedings.

In view of the investigation, proceeding in this case and the police authorities have been able to establish the complicity of the petitioner, I am of the view till the opinion of the investigating officer is arrived at by way of filing report under Section 173 of the Code of Criminal Procedure, it would not be fit and proper to interfere in respect of the investigation which is continuing at this stage. With the aforesaid observations, the revisional application being CRR 1395 of 2021 is dismissed.

Pending applications, if any, are disposed of. Report so submitted by the SI of Police, Madhyamgram PS, Barasat Police District through the learned advocate for the State be kept with the record.
