Even today when the matter is called on for hearing none appears for any of the respondents.

Learned counsel for the petitioner submits that the petitioner sought for a new electricity connection which is not being given by the Distribution Licensee due to obstruction created by the private respondents. Since, despite getting several opportunities, the Distribution Licensee and/or the private respondents are not represented through counsel, the matter is being taken up ex parte for disposal.

Upon a perusal of the documents-on-record, it transpires that the petitioner, being in occupation of the premises where electricity has been sought, is entitled to get an electricity connection under Section 43 of the Electricity Act, 2003.

There cannot be any conceivable reason why opposition is being raised thereto, particularly in view of the photographs annexed to the affidavit-in-opposition of respondent nos.7 to 10 itself indicating that several other

connections have already been given at the premises-inquestion. Hence, WPA 9812 of 2022 is disposed of by directing the WBSEDCL to process the application for new connection of the petitioner and, subject to compliance of all formalities by the petitioner, give such connection within a fortnight from the compliance of such formalities.

In the event any obstruction is offered by the private respondents and/or their men and agents, it will be open to the WBSEDCL personnel to approach respondent no.6, the Officer-in-Charge of the Domjur Police Station for police assistance.

If so approached, the Officer-in-Charge shall grant such assistance at the cost of the petitioner. The police personnel will be at liberty to take due steps for removal of any hindrance, if put up by the private respondents and/or their agents in giving such connection to the petitioner, of course, subject to due compliance of all formalities by the petitioner.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
