The petitioner alleges that the Inspector-in-Charge, Kaliganj Police Station has failed and neglected to take steps pursuant to the repeated complaints filed by the petitioner with regard to the death of her minor son. It is alleged that the minor son of the petitioner died under mysterious circumstances. The police authorities had failed and neglected to accept the complaint earlier, thereafter once the writ petition was filed, Kaliganj Police Station Case No.357 of 2022 dated June 8, 2022 under Section 302/34 of the Indian Penal Code was initiated. The petitioner prays that the investigation be handed over to the Criminal Investigation Department.

The police authorities have already initiated an investigation. This court directs that the said investigation shall be completed within a period of three months from the date of communication of this order, in a free and fair manner.

Needless to mention, that serious effort shall be made for obtaining report of the chemical examination and viscera. Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the sever copy of this order.
