10.06.2022 cm/ct 28 C.R.M.(A) 2502 of 2022 sl no. 92 In Re : An application for Anticipatory bail under section 438 of the Code of Criminal Procedure in connection with Gangnapur P.S. Case No. 77 of 2022 dated 19.03.2022 under Section 306 of the Indian Penal Code. And Rejected In Re : Subhendu Kar @ Suvendu ..... petitioner Mr. Kallol Mondal Mr. Krishan Ray Mr. Subir Debnath Ms. Roma Roy ...... for the petitioner Mr. P. Bhattacharyya Mr. Pratick Bose ...... for the State It is submitted on behalf of the petitioner that he is the brother of the victim lady and he has been falsely implicated in the instant case.
Learned advocate appearing for the State opposes the prayer for anticipatory bail.
We have considered the materials on record including suicide note left behind by the victim which implicates the petitioner. Keeping in mind the aforesaid incriminating facts, we are of the opinion custodial interrogation is necessary and this is not a fit case to grant anticipatory bail to him.
The application being CRM(A) No. 2502 of 2022 is rejected. (Ananya Bandyopadhyay, J.) (Joymalya Bagchi, J.)
