During the course of submissions, it has transpired that petitioner has filed a domestic violence petition against the opposite party/husband which is pending at in the court of learned Judicial Magistrate, 4th Court at Siliguri. The petitioner is praying for the transfer of Matrimonial Suit No.152 of 2025 pending the learned Additional District Judge, Fast Track Court, 1st Court at Burdwan, Purba Bardhaman to the court of competent jurisdiction at Siliguri.

Learned counsel for the opposite party has fairly submitted that appropriate directions may be issued so that both the matters, i.e., Domestic Violence Act and the present matrimonial petition are

taken upon on the same day so as to avoid any unnecessary inconvenience/trouble on part of the opposite party. The request made is very fair and reasonable.

In view of the submissions made the Matrimonial Suit No.152 of 2025 is withdrawn from the learned Additional District Judge, Fast Track Court, 1st Court at Burdwan, Purba Bardhaman and the assigned to the court of competent jurisdiction at Siliguri, Darjeeling. Both the courts are directed to ensure that both the cases are listed on the same day so as to avoid any inconvenience to the parties. Transferor court is directed to send the record to transferee court. Copy of the order be sent to the transferor court to transferee court.

The petition stands disposed of.

All connected applications, if pending, are also disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
