Petitioner claims that there has been obstruction created in the free egress and ingress and an encroachment has been made at the behest of the private respondents. Petitioner earlier approached the learned Executive Magistrate wherein direction was passed in the year 2022 for removal of obstructions. Petitioner now claims to execute such order of the Executive Magistrate which was passed on 30.06.2022.

According to the report submitted on behalf of the State, petitioner is presently residing at the said place and shifted his residence beside Khejuri Battala to Hijli pitch road at Arakbari. Further the police authorities have stated that presently there is no obstruction in ingress and egress of the petitioner Paresh Chandra Das, accordingly, certain photographs have been enclosed along with the report.

Having considered the fact that the information which have been furnished before this Court are based over incidents of the year 2022 and the police authorities' report is dated 20.05.2025, I am of the view that in case the petitioner faces further inconveniences he would approach the jurisdictional Civil Court for appropriate remedies. The police authorities are further directed to ensure that over the issue relating to egress and ingress there is no breach of the peace and/or tranquility and/or any untoward incident resulting there, between the petitioner and the private respondents.

With the aforesaid observations WPA 10306 of 2025 is disposed of.

Report submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
