Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner filed an application for interim maintenance for herself and for her two minor children on 24.07.2024. But, the husband/opposite party is trying to delay the proceeding on some pretext of the other. He would appear on a day and pray for adjournment to file vakalatnama on the next date. The proceeding has remained pending for no fault of the present petitioner.

An application for maintenance allowance, especially for interim maintenance has to be dealt with utmost seriousness and promptitude. It would be a question of survival in the interregnum. In view of the above and in the interest of justice, the learned Judicial Magistrate, 5th Court, Barrackpore is directed to expedite the proceeding in case no.561 of 2024 and decide the question of interim maintenance in accordance with law and as expeditiously as possible, positively within a period of four months from the next date of hearing. With these observations and directions, the revisional application is disposed of.

Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for.
