Learned advocate appearing for the petitioner submits that there has been alleged recovery of 337 grams of Brown Sugar and 438 grams of Yaba tablets. Petitioner is in custody for 1 year 3 months and till date, only one witness has been examined, although prosecution has relied upon 17 witnesses in support of its case.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that prosecution intends to examine 14 witnesses.

Having considered the quantum of recovery in the present case, I am of the opinion that the petitioner has failed to overcome the rigours of Section 37 of the NDPS Act. As such, the prayer for bail of the petitioner is rejected. The application for bail, being CRM (NDPS) 954 of 2026, is, thus, dismissed.
