This writ petition has been filed alleging disobedience of the order of the learned Additional Chief Judicial Magistrate, Baruipur, by the authorities of the Baruipur Police Station. According to the petitioner, although the learned Magistrate passed an order directing the police authorities to register an F.I.R. on May 19, 2022 and file a report, the police authorities have failed and neglected to comply with the order.

The report filed by the police authorities before this court today, indicates that the F.I.R. was registered on June 8, 2022 and Sonarpur P.S. Case No. 597 of 2022 dated June 8, 2022 under Section 406/420/506/120B of the Indian Penal Code was initiated. The investigation is under progress. The next date fixed for compliance and report, by the Learned ACJM is June 23, 2022. The report of compliance shall be filed.

It appears that the police authorities have already complied with the order and investigation is under progress.

Under such circumstances, this Court is of the view that the police authorities have acted on the basis of the direction of the learned Magistrate.

Under such circumstances, this writ petition is disposed of with a direction upon the police authorities to conclude the proceeding, already initiated, strictly in accordance with law, within a period of three months from the date of communication of this order. The police report is taken on record.

Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
