Commercial quantity of phensedyl was recovered from the fertilizer shop of the petitioner pursuant to information supplied by him. This is as good as recovery from his possession. In view of the restriction in Section 37 of the Narcotic Drugs and Psychotropic Substances Act, 1985, we are not inclined to entertain the petitioner's prayer for bail. Charge has been framed. Date has been fixed for recording of evidence. The petitioner is in custody for about 352 days. In view of the petitioner being in custody for quite sometime, we request the learned Trial Court to expedite the trial to the extent possible and bring it to its logical conclusion as soon as the business of the Court may permit. Accordingly, the application for bail being CRM 4491 of 2021 is dismissed.
