No. 29 CHC Rejected C.R.M.(A) 1420 of 2024 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Neturia Police Station Case No. 26/2024 dated 23.02.2024 under Sections 379/411/414/120B of the Indian Penal Code, 1860, read with Section 21(1)(4) of Mines and Minerals (Development & Regulation) Act, 1957.

And In the matter of : Manik Kaibarta @ Manik Kaibartta ...... petitioner Mr. Brajesh Jha, Mr. Rishav Kumar Thakur ....for the petitioner Mr. Madhusudan Sur, Ld. A.P.P., Mrs. Shaila Afrin ....for the State Petitioner before us is the owner of the vehicle which was seized carrying illegally mined sand.

Role of the petitioner in the incident requires investigation.

Enlarging the petitioner on anticipatory bail at this stage will send a wrong signal to the society particularly, when illegal sand mining is a bane so far as the State is concerned. In such circumstances, we are unable to grant anticipatory bail to the petitioner.
