C.R.M. (DB) 1498 of 2022 (AD) 01.07.2022 Court No.29 In Re: - An application under Section 439(2) of the Criminal Procedure Code for cancellation of anticipatory bail. And In the matter of: - Satya Ranjan Giri ...petitioner.

Mr. Sk. Sahjahan Ali ... for the Petitioner.

Ms. Faria Hossain Ms. Baisali Basu ... for the State.

Affidavit of service filed in Court be taken on record. Learned Advocate appearing for the petitioner submits that the High Court granted anticipatory bail to the private opposite party on March 24, 2022. The suicide note was seized subsequent thereto. He refers to the suicide note.

State is represented.

The suicide note contains a statement that the petitioner is one of the persons who is responsible for the death of the victim. On the basis of such suicide note, whether or not the petitioner is guilty of abeting the suicide is an issue which is required to be decided at the trial.

In such circumstances, we find no material to revisit the order granting anticipatory bail to the private opposite party on March 24, 2022 in CRM 6688 of 2021.

C.R.M. (DB) 1498 of 2022 is, therefore, dismissed. (Debangsu Basak, J.) (Bibhas Ranjan De, J.)
