Ghosh Mr. Raja Ghosh ..... for the respondents Learned counsel appearing for the respondent Railways is agreeable to the writ petition being disposed of in terms of prayer (a). Counsel however raises an objection to any relief with regard to extend the tenure of the lease.
After hearing learned counsel, the lifetime of the lease extends till April, 2023. This Court cannot therefore direct the Railways to continue the tenure of the lease and restrain them from holding a fresh tender in respect of a new lis.
WPA 9846 of 2022 is accordingly disposed of in terms of prayer (a) of the writ petition. The respondent No. 3 being the Senior Divisional Commercial Manager, Eastern Railway, Howrah Division is directed to accept the license fees of the petitioner as per the letter dated 17.03.2022 in three equal installments and not take
any coercive step against the petitioner after accepting the license fees. The petitioner shall put in the license fees within a fortnight from date as prayed for. The petitioner shall also pay the current rate as was being paid by the petitioner in the usual courses.
