The present revisional application was preferred challenging the continuance of Tala Police Station Case No.89 of 2022 dated 19.10.2022 under Sections 379/114 of the Indian Penal Code.

Ms. Debjani Sahu, learned advocate appearing for the State has produced the case diary as well as the charge-sheet which reflects that the report in final form has been submitted in the month of May, 2023 and the police authorities after investigation has arrived at their findings that due to mistake of fact no case could be made out by the Investigating Agency. The subject matter involves bicycle, which turned into scrap and sold of.

Having regard to the same, I am of the opinion that the revisional application, as such, has become infructuous in view of the prayer submitted by the Investigating Agency.

Consequently, CRR 1575 of 2023 is dismissed as infructuous as no case is at present pending against the petitioners. Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
