For the State Counter-affidavit filed by the petitioner against the report filed by the State Authorities is taken on record. Heard learned counsels for the parties.

The simple grievance of the petitioner is that she purchased the land in question from the erstwhile owner by virtue of a registered deed dated 28th September, 1956 and her name was recorded in the R.S. Record of Rights. The property was requisitioned in terms of Section 3(i) of the West Bengal Premises Requisition and Control (Temporary Provisions) Act, 1947 by the Government before more than 25 years. By a notice dated 8th July, 2008 the Land Acquisition Collector, Burdwan informed the petitioner that the land would be released from requisition subject to

submission of documents relating to ownership of the premises within 7 days of receipt of the letter. The petitioner complains that despite submission of such documents by her within time, the land has not yet been derequisitioned and the petitioner is unable to enter into the same land for which third party strangers are attempting to take possession of the land illegally.

Having considered the submissions made on behalf of the parties and material on record, the writ petition is disposed of with liberty to the petitioner to file a comprehensive representation before the 4th respondent within a week from date. Such representation shall be considered by the 4th respondent within four weeks from the date of receipt thereof after giving reasonable opportunity of hearing to the petitioner, in accordance with law.

W.P.A. 9308 of 2019 is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
