Banu ..... for the State Bank of India Mr. Durga Prasad Dutta Ms. Aditi Dutta .... for the respondent No. 6 The petitioner seeks appropriate orders against the concerned respondent in terms of an application under The Right to Information Act, 2005, made by the petitioner on 04.02.2022. The petitioner has sought the Bank account details of her deceased brother who died intestate on 05.11.2021.

The respondent Bank as well as the Information Officer objects to the prayer on the basis that the petitioner has not provided any details of the fact that the petitioner is the sole surviving heir of her deceased brother. It is also submitted that the petitioner did not file any appeal under Section 19 of the 2005 Act despite being refused the information sought for.

After hearing learned counsel, the Court accepts the fact that the petitioner should prove that the petitioner has any sale or exclusive right to the Bank

account details of her deceased brother since there are other legal heirs who are before the Court. The respondent No. 4 Bank is hence directed to inform the petitioner in relation to the right of the petitioner to the information sought along with supporting documents within a period of 15 days as prayed for. The petitioner shall be at liberty of responding to the same within a week thereafter.

WPA 9851 of 2022 is disposed of in terms of the above.

The private respondents shall also be at liberty of approaching the Bank if required. The Bank shall not take any steps in terms of disbursing any amount from the said account till the Bank hears all the parties. (Moushumi Bhattacharya, J.)
