In view of the innocuous nature of the order proposed to be passed, no prior service of notice on the opposite party is deemed necessary.

It appears from the materials annexed to the revisional application, as well as from the submission of learned counsel for the petitioner, that the hearing of the suit for specific performance of contract, filed by the petitioner, is being inordinately delayed.

It is submitted that even the records cannot be traced out for commencement of hearing of the suit.

Keeping in mind the difficulty faced by the subordinate courts in functioning due to the pandemic situation, a reasonable period ought to be granted for disposal of the suit. However, the

urgency pleaded by the petitioner cannot be overlooked as well.

In such scenario, C. O. No. 1236 of 2021 is disposed of by requesting the Civil Judge (Senior Division), First Court at Barasat, DistrictNorth 24 Parganas, to dispose of Title Suit No. 418 of 2014, along with pending applications, if any, filed in connection therewith, as expeditiously as the business of the said court permits, positively within one year from the date of communication of this order to the court below. The petitioner shall communicate this order to the court below, as well as to the opposite party and/or the learned advocate appearing for the opposite party in the court below, at the earliest.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
