Ms. Manali Biswas .....For the Petitioners A direction to secure expeditious disposal of Execution Case No.3 of 2014, is the ultimate relief sought for in this case. The only contention expressed by the learned advocate for the petitioners is against the delay caused in the disposal of pending execution case instituted in the year 2014. No other point is raised requiring address by this Court. Incidentally it is brought to the notice of this Court that a Miscellaneous Case No.11 of 2018 is pending before the Court of Learned Civil Judge (Junior Division), 1st Court, Berhampore, Murshidabad.

In view of the nature of the order proposed to be made in this case, no prior notice upon the opposite parties is considered to be necessary. Service of notice of this application upon opposite party stands dispensed with.

Accordingly, the pending Miscellaneous Case needs to be disposed of.

Accordingly, Learned Civil Judge (Junior Division), 1st Court, Berhampore, Murshidabad in Misc. Case No.11 of 2018 arising out of Title Execution Case No.3 of 2014, is requested to ensure expeditious disposal of such Misc. Case, after disposal of interlocutory application, if there be any pending, providing sufficient opportunity of hearing to either of the parties to this case, but without granting any unnecessary adjournment, unless it is extremely unavoidable.

Petitioners are directed to make communication of this order upon the opposite parties and their learned advocates appearing in the court below for the opposite parties.

With this direction and observation the revisional application stands disposed of.

Urgent certified photostat copy of this order, if applied for, be given to the parties as expeditiously as possible on compliance of all necessary formalities.
