Learned advocate appearing for the petitioner submits that the petitioner is in custody for 175 days and he has been implicated in the present case on the basis of statement of co-accused who has already been granted bail on 17.06.2026 in CRM (NDPS) 953 of 2026 from whom seizure has been made.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that there are criminal antecedents so far as the present petitioner is concerned and commercial quantity of contraband has been seized in connection with the instant case.

I have considered the submissions of the respective parties. It reflects from the records that total seizure in the present case is 478 grams of Heroin and there has been no recovery from the present petitioner and the implication of the present petitioner is on the basis of statement of

co-accused and other attending materials. Having considered the same and the other accused viz. Estab Sk who has been granted bail on 17.06.2026 in CRM (NDPS) 953 of 2026, I am of the opinion that the present petitioner viz., Abdus Salam @ Abdus Samad @ Gonga be released on bail by the learned Trial Court on the same terms and conditions as the other accused who has been granted bail in CRM (NDPS) 953 of 2026.

Accordingly, the prayer for bail of the petitioner is allowed.

The application for bail, being CRM (NDPS) 964 of 2026, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
