This appeal is directed against an order dated February 26, 2026, passed in WPA 20504 of 2024. The dispute is between the University and some of its students.

Considering the young age of the concerned students and that their entire career may be in jeopardy if the University does not take a sympathetic view, we requested learned senior counsel representing the University to discuss with his clients as to what best can be done under the circumstances.

Learned senior counsel for the University on instruction submits that even though the private respondents in this appeal have not preferred any separate appeal from the order dated February 26, 2026, three of them being respondent nos. 14, 15 and

16 in this appeal, are similarly circumstanced as the three appellants. The three appellants and the private respondent nos.14, 15 and 16 have already suffered the proposed punishment mentioned in the showcause notice which is under challenge in the writ petition, by reason of deferment of their course in spite of the said students having undertaken their respective semester examinations.

The private respondent nos. 10, 11, 12 and 13 are yet to cover the length of the proposed punishment mentioned in their respective show-cause notices, as impugned in the writ petition.

We have heard Mr. Majumdar, learned senior counsel for the University as well as Mr. Chatterjee, learned advocate for the appellants. At the suggestion of learned counsel for the parties, we dispose of the appeal by modifying the impugned order in terms of the following directions :

a) The writ petition shall stand withdrawn in so far as the three appellants and private respondent nos.14, 15 and 16 herein are concerned.

b) The University shall publish the pending results of the appellants and the private respondent nos. 14, 15 and 16 within a week from today (June 26, 2026).

c) The appellants and the private respondent nos. 14, 15 and 16 shall be entitled to take their backlog papers (if any) along with the odd and even semester examinations, which commence on and from June 29, 2026 and depending on the semester papers which they might not have cleared.

d) For the final semester students amongst the three appellants and the private respondent nos.14, 15 and 16, if there is any backlog paper(s) in the final semester, he/they shall be entitled to appear at the Special Supplementary Examination that may be held along with other final semester students of the same discipline.

e) If required, the appellants and the private respondent nos. 14, 15 and 16 will register as casual students in accordance with the applicable rules of the University.

We clarify that the writ petition comes to an end in so far as the appellants and the private respondent nos. 14, 15 and 16 are concerned. The learned Single Judge is requested to decide the writ petition in so far as the other writ petitioners are

concerned, in accordance with law without being influenced by anything in this order.

MAT 814 of 2026 is disposed of along with the applications being I.A. No. CAN 1 of 2026 and I.A. No. CAN 2 of 2026.
