Certified copy of the affidavit of Sushil Kr. Choudhury and Sankar Prasad Ghosh along with the order dated 08.12.2022 has been brought to the notice of this Court. The same reflects that an amount of Rs.2,00,000/- was directed to be deposited in connection with C. Case No.33299 of 2010 pursuant to the order passed by the High Court. A direction was also passed for the complainant to withdraw the said amount.

Learned Magistrate is directed to check the records of the case and if whole of the amount which has been settled has been received by the complainant and a further sum of Rs.2,00,000/- is lying in connection with C. Case No.33299 of 2010 then the same may be returned to the accused Sankar Prasad Ghosh, who happens to be the proprietor of M/s. Priya Enterprise. If this order is brought to the notice of the learned Metropolitan Magistrate, 20th

Court, Calcutta, the learned court would pass necessary directions after checking the records of the case within a period of ten days. With the aforesaid observations, CRR 1578 of 2023 is disposed of.

Pending connected application, if any, is consequently disposed of.
