1. Affidavit-of-service filed in court today be kept on record.

2. In view of the innocuous nature of the order proposed to be passed, further service is not directed, although the respondents are not represented despite service.

3. Learned counsel for the petitioner-bank is justified in arguing that its application under Section of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI Act, 2002) against the private respondents has been kept pending since December 26, 2019, which is much beyond the statutory outer limit of sixty days.

4. Accordingly, WPA No. 10395 of 2023 is disposed of by directing respondent no. 2, that is, the District Magistrate, Birbhum, to dispose of the pending application filed under Section 14 of the SARFAESI Act, 2002 at the behest of the petitioner against the private respondents as expeditiously as possible, positively within three weeks from the date of communication of this order to the said respondent no. 2.

5. There will be no order as to costs.

6. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
