Affidavit of service filed today be kept with the record. As prayed for, leave is granted to the writ petitioner to correct the description of the respondent no.2.

The writ petitioner, who claims to be a handicapped person with 50% disability, seeks issuance of a Writ of Mandamus upon the respondent no.3/Regional Transport Authority, Purba Bardhaman to consider the petitioner's application for permit in respect of stage carriage (Trakker) to be plied on the route Sutraghat to Bamunpara via Kusumgram. It is submitted that an application for new stage carriage permit was made before the respondent no.3/ Regional Transport Authority, Purba Bardhaman way back in December 2023 along with requisite fees but such application has not yet been considered and disposed of by the respondent no.3/ Regional Transport Authority, Purba Bardhaman.

Upon it being pointed out by the Court that the copy of the application for route permit made by the writ petitioner annexed at pages 15 and 16 of the writ petition is undated, it is submitted that the original application that had been filed before the authority was properly dated and that, in any event, the same was accompanied by the requisite fees which, were paid to the concerned department on December 27, 2023, which will be evinced from a receipt issued in such regard, a copy whereof has been annexed at page 17 of the writ petition. In view of the nature of grievance raised by the writ petitioner, justice would be sub-served, if this writ petition is disposed of by directing the respondent no.

3/ Regional Transport Authority, Purba Bardhaman to consider and dispose of the petitioner's application for new stage carriage permit (Trakker), which had been filed before the said authority (a copy whereof forms annexure P1 to writ petition at pages 15 and 16 thereof) along with requisite fees (a copy of receipt whereof is annexed at page 17 of the writ petition), within a period of six weeks, strictly in accordance with law upon giving an opportunity of hearing to the writ petitioner and/or his representative, by passing a reasoned order. It is needless to mention that the respondent no.

passing thereof.

With the aforesaid observations, the WPA 10350 of 2025 stands disposed of.

There shall, however, be no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied as expeditiously as possible. (Om Narayan Rai, J.)
