Mr. Souvick Mitra Ms. Shetparna Ray ...for the petitioner Mr. Soumya Banerjee Ms. Sucheta Banerjee ...for respondent no.2 The petitioner has filed this writ petition seeking the removal of her husband's name from the birth certificate of her minor son, issued by Kamarhati Municipality. The petitioner asserts that she has obtained an order from the competent Civil Court declaring her as the sole guardian of her minor child, Himadri Sutradhar.

I am of the opinion that the order appointing the petitioner as the sole guardian of her minor son does not mandate the deletion of the father's name from the birth certificate. The order solely authorises the petitioner to fulfill the duties and responsibilities associated with guardianship.

However, during the hearing, the learned advocate representing the petitioner indicated that the petitioner now wishes only to change her son's name from "Himadri Sutradhar" to "Himadri Saha" and her own name to "Tandrima Saha."

The petitioner is at liberty to approach Kamarhati Municipality with the necessary documentation supporting her prayer for change of names. Should such a request be made, Kamarhati Municipality shall take the necessary steps in accordance with the law as expeditiously as possible. Accordingly, WPA 11275 of 2024 is disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties on compliance of usual legal formalities.
