The grievance raised by the petitioner is that Plot No.362, Khatian No.3479 at Block - Bhagwangola, Murshidabad is a water body classified as "waterways" but the private respondents have encroached upon the said water body and are raising construction thereon. It is pointed out that the petitioner has filed the representation dated 16.02.2022 before the respondent no.5 i.e. Block Land and Land Reforms Officer, Bhagwangola Block and the said representation does not contain the full particulars.
Learned counsel for the State submits that if the petitioner files the detailed fresh representation, his grievance will be looked into.
Hence, we dispose of the present petition
permitting the petitioner to file a comprehensive detailed representation before the respondent no.5 and on receipt of the said representation, the respondent no.5 will give an opportunity of hearing all the concerned parties and will duly examine the land record and thereafter take an appropriate action in accordance with law.
Let this exercise be completed within a period of three months from the date of receipt of the said representation.
The petition is, accordingly, disposed of.
