Mr. Partha Pratim Roy, Mr. Sarbananda Sanyal ...for the petitioners It is rightly pointed out by learned counsel appearing for the petitioners that, despite two previous directions of this Court for expeditious hearing, the trial court has failed to dispose of Title Suit No. 17 of 1990, pending before it, till date. It appears from the submission of learned counsel for the petitioners that certain interlocutory applications (miscellaneous cases) are pending as well in connection with the said suit.

Keeping in view the earlier directions, it is unfortunate that the suit could not be disposed of till date.

In view of the innocuous nature of the order proposed to be passed, no prior service of notice on the opposite parties is deemed necessary.

C.O. No. 1241 of 2021 is disposed of by directing the Civil Judge (Senior Division), Ninth Court at Alipore, District-South 24-Parganas to peremptorily dispose of Title Suit No. 17 of 1990, along with all connected applications and miscellaneous cases, within six months from the date of communication of this order to the court below.

It is made clear that such direction is mandatory and the trial court shall not grant any unnecessary adjournment to either of the parties. The petitioners shall communicate this order to the court below as well as to the learned advocate appearing for the opposite parties in the court below at the earliest.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the petitioners upon compliance of all necessary formalities.
