1. None appears on behalf of the bank.

2. Affidavits of service filed in Court today are taken on record.

3. The petitioner's representation before the authorized officer of the Union Bank of India requesting removal of the movable articles from the auctioned property is pending consideration.

4. As it appears that the request of the petitioner is pending disposal at the end of the bank, accordingly, the instant writ petition is disposed of by directing the Assistant General Manager/ Authorized Officer, Union Bank of India being the respondent no. 8 herein to take a decision with regard to the prayer of the petitioner for removing the movable articles after giving opportunity of hearing to all the necessary parties.

5. If the prayer of the petitioner cannot be acceded to, then reasons therefor shall be made known to the petitioner.

6. Steps shall be taken in the matter at the earliest but positively within a period of four weeks from the date of communication of this order.

7. If the prayer of the petitioner is allowed, then it will be open for the aforesaid respondent to take police assistance of the concerned police station for the purpose of removing the movable articles, if required.

8. The petitioner submits that it has incurred huge amount of money for maintaining security guards for protection of the movable goods which does not belong to the petitioner but belongs to the borrower who failed to collect the goods in proper time. He seeks damages.

9. It will be open for the petitioner to approach the competent forum claiming damages in accordance with law, if so advised.

10. The writ petition stands disposed of.

11. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all the requisite formalities.
