2. Affidavit of service filed in Court today is taken on record.

3. The petitioners pray for consideration of the representation dated 10th July, 2023 made before the Additional Secretary H.S. (M.S) Branch, Department of Health & Family Welfare, Government of West Bengal.

4. The petitioners assert that the eligibility conditions fixed by the department for issuance of new bid document are contrary to the principles of equality, fair play and natural justice.

5. Without entering into the merit of the representation filed by the petitioners, the instant writ petition is disposed of by directing the respondent no. 3 to consider and dispose of the said representation in accordance with law and the prevailing guidelines at the earliest but positively within a period of twelve weeks from the date of communication of this order.

6. A reasoned order shall be passed and communicated to the petitioner immediately thereafter.

7. Learned advocate for the petitioners is directed to forward a copy of the representation dated 10th July, 2023 along with all supporting documents to the aforesaid respondent at the time of communicating the order of the Court.

8. The writ petition stands disposed of.

9. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
