The husband of the petitioner was an employee of Chanchal College, Malda. He died-in-harness on May 23, 2018. The widow has come forward with a prayer for releasing the service benefits which was due and payable in favour of the employee.

The learned advocate representing the State respondents submits, upon instruction, that the paper works required for processing the file of the deceased employee cannot be completed due to non-availability of the petitioner, accordingly necessary direction may be passed upon the petitioner to put the signatures in the

requisite papers so that the same may be forwarded for disbursal of the dues.

The learned advocate for the petitioner submits that the petitioner had indeed put in some signatures in the documents.

The learned advocate is, however, not sure as to whether all the necessary documents have been signed by the petitioner or not.

In view of the above, the instant writ petition is disposed of by directing the petitioner to put in her signatures in the necessary documents in the college so that the papers may be forwarded by the College Authority to the concerned department for processing the same.

The college shall forward all the documents of the deceased employee the moment the petitioner puts in her signatures in the said documents. After the documents are forwarded by the college the concerned authority shall take steps to disburse the dues of the petitioner, strictly in accordance with law, at the earliest, but positively within a period of six months from the date of submissions of all documents.

The College Authority shall intimate the date and time to the petitioner to put in the signatures in the necessary documents of the college.

The writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties after completion of all legal formalities.
