Mr. Binoy Kumar Panda, learned advocate, and Mr. Pratick Bose, learned advocate, who usually appear on behalf of the State, are present in Court. They are requested to appear on behalf of the State in this matter. Their appointment may be regularized by the concerned authority.

Learned lawyer on behalf of the State appears and submits that the case is pending since 2011. No steps have been taken by the petitioner for hearing of this matter. Considering all facts and circumstances, he prays for dismissal of the revisional application.

From the record, it appears that no stay has ever been granted by this Court and moreover, the revisional application is pending since 2011. From the cause title of the revisional application it is found that order dated 30-12-2010 passed by the learned Judicial Magistrate, 1st Court, Siliguri, in connection with Misc. Case No.15 of 2010 corresponding to M.R. Case No.41 of 2010 under Section 125 of the Code of Criminal Procedure, was challenged. From the copy of the order dated 30-12-2010, it is found that one application was made before the learned Judicial Magistrate, 1st Court, Siliguri, praying for an adjournment in favour of the opposite party on the ground that the revisional application was filed before this

Court and accordingly, learned Judicial Magistrate allowed the prayer and directed to file order of this Court and the next date was fixed on 29-01-2011.

After careful scrutiny of the order, I do not find any illegality or irregularity in the order itself. Therefore, the instant revisional application, having no merits, stands dismissed.

Let a copy of this order be communicated to learned Judicial Magistrate, 1st Court, Siliguri, through the learned Registrar, Judicial Service, of this Court.

All parties shall act on the server copies of this order duly downloaded from the official website of this Court. Urgent photostat certified copies of this order, if applied for, be supplied to the parties on compliance of all necessary formalities.
