The petitioner aggrieved by the summons issued by the BSF under Section 89 of the BSF Act, 1969. The summons was issued under procedure prescribed under Chapter 14 of the BSF Rules of 1969.

The petitioner submits that she could not attend the enquiry due to her indisposition but had sent legal representative and the petitioner also sought to certain documents. Counsel for the BSF submits that the Board of Enquiry constituted, has since submitted its report to the concerned authorities. The writ petition has, therefore, become infructuous. Since it is submitted by the BSF that the petitioner is not an accused in any proceeding, the Court is not inclined to entertain the writ petition any further. The writ petition is dismissed.

There shall be no order as to costs.
