Mr. Binay Kumar Panda and Mr. Narayan Prasad Agarwala, learned advocates who usually appear on behalf of the State are present in Court. They are requested to appear on behalf of the State in this matter.

Their appointment may be regularized by the concerned authorities.

Learned advocates on behalf of the State appear and submit that this revisional application under Article 227 of the Constitution of India should not be continued after an order passed by this Court on 20.01.2014 whereby directing the learned Court below to proceed with the matter according to the law. Learned advocates on behalf of the State accordingly pray for dismissal of this revisional application. After careful perusal of the impugned order dated 17.03.2011 passed by the learned Sessions Judge, Purba Medinipur in CR Misc. Case No.819 of 2010 whereby learned Sessions Judge refused to allow the prayer for transfer of the case under Section 376/506 of the Indian Penal Code from the

jurisdiction of Contai to Tamluk due to some reasons and in that case, learned Sessions Judge also gave opportunity to the petitioner to approach before the learned Trial Court with regard to security matter as the time of to and fro journey. However, after careful perusal of the entire order impugned, I do not find any irregularity in the order to interfere. Moreover, this Court already directed learned Court below to proceed with the case according to law.

Having considered the facts and circumstances of the case, I am not inclined to proceed with this revisional application further.

Accordingly, CRR 1686 of 2011 is considered and dismissed.

Let a copy of this order be communicated to learned Sessions Judge, Purba Medinipur though learned Registrar, Judicial Service of this Court.

Urgent certified photostat copy of this order, if aplied for, shall be given to the parties as expeditiously as possible on compliance of all necessary formalities.
