Petitioners are aggrieved by the fact that inspite of direction passed upon the Officer-in-Charge, Singur Police Station ensuring that the temporary injunction and restrain order in relation to the construction of the schedule property be given effect to - it has been complained that the police authorities did not comply with the order so passed by the learned Civil Judge (Junior Division), 1st Court, Chandernagore, Hooghly in connection with T.S. 35/16.

State has submitted a report and categorically stated that no new construction is in progress. Having considered that the police authorities have categorically asserted that there is no sign of recent construction, I direct that in case there is any violation of the order, police authorities would be at liberty to take steps by drawing up necessary FIR if any cognizable offence is committed.

Petitioners would be at liberty to also inform the police authorities for taking steps. In case the petitioners are of the opinion that there has been violation of the orders of the Civil Court inspite of the assertions made by the police authorities, petitioner would advance appropriate prayer before the Civil Court for inspection in respect of the truth attached to the contention in respect of the assertion relating to "no recent construction being proceeded by the private respondents" as made by the police authorities in their report.

With the aforesaid observations WPA 10376 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
