Advocate for the petitioner submits that because of circumstances beyond his control, he could not appear on 20th of March, 2024, as such, warrant of arrest was issued. According to the ld. Advocate date was fixed for delivery of judgment in connection with Sessions Case No. 104 of 2017 before the ld. Addl. Sessions Judge, Rampurhat, Birbhum.

In view of the date so fixed for delivery of judgment i.e. on 4th of May, 2024 (as has been submitted by the ld. Advocate for the petitioner) as also the date fixed for execution of warrant of arrest, I direct that if the petitioner appears in connection with the instant case, the ld. Trial

court will not take any exception for absence on 20th of March, 2024.

Until and unless the judgment of the trial court is such that, the court is to take any adverse decision, the execution of warrant of arrest be stayed till till 4th of May, 2024.

With the aforesaid observations, CRR 1676 of 2024 is disposed of.

Pending application, if any, is also disposed of. Report so submitted be kept with the record.
