The present writ petition has been preferred against the Memo no.

C/Ins.IV/41000440090001303/742012121/1928 dated 13.08.2012 and Memo no.

41000440090001303/CP/59240/C-33337/14-15/3 dated 02.06.2014 both issued by the Deputy Director of the ESI Corporation.

It is further submitted that the petitioner has prayed for cancelling of the said orders and has prayed for consideration of the representation made by the petitioners challenging the said memos before the Deputy Director of the ESI Corporation. It appears that the representation is still pending before the said authority. Considering the materials on record and the relief prayed for, the writ application is disposed of with the direction that the respondent Deputy Director, ESI

Corporation shall dispose of the representation dated 12.02.2014 (A copy of the same may be provided to the Deputy Director by the petitioner in case the same is not available with the authority) on considering the documents and submissions of both the parties and shall dispose of the same within a period of two months from the date of communication of this order in accordance with law.

There will be no order as to costs.

All connected applications, if any, stand disposed of.

Interim order, if any, stands vacated.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
