Learned counsel appearing on behalf of the petitioner submits as follows. Some of the relatives of the present petitioner are the accused in a murder case being Margram PS Case No. 27 dated 05.02.2023. Immediately after the incident, the local people attacked the petitioner's house and ousted him and other relatives from their respective homes. The petitioners were in mortal fear of danger and were not in
a position to return home. The threats and intimidation continued. As the petitioners wanted to return home, they moved a writ petition being WPA 23261 of 2023. By an order dated 27.09.2023, this Court directed the police to escort them back to their residence. The same was done. Now, the petitioner wants to open his shop rooms in the locality, but the private respondents are threatening and preventing him from doing so. This was brought to the notice of the police, but they did not act.
Learned counsel appearing on behalf of the State denies the allegations, relies on the report and submits as follows. In compliance of the earlier order passed by this Court, the police rendered necessary help to escort back the petitioner and others to their home. After that, it was the petitioner who did not take steps in opening his shop in the locality. In fact, he had got two shops there. The police are keeping a close watch at the locale. In fact, there is a police picket at a particular place.
It appears that the police have already rendered necessary help to escort back the petitioner and others to their residence as per the earlier order. It also appears from the report that there is a 24 hours' police picket near the petitioner's house.
In the event the petitioner finds any difficulty in opening his shops and carrying on his business, he shall be at liberty to make necessary representations to the Officer in Charge of the Margram Police Station who shall then act in
accordance with law.
No further order need be passed in this regard. With these observations, the writ petition is disposed of.
