The writ application has been preferred being aggrieved by orders dated 25.11.2025, 02.01.2026 and 02.03.2026 passed by the learned CGIT, Asansol.

Vide the impugned orders, it appears that the matter was registered before the learned CGIT, Asansol on 27.08.2025. On the next date that is on 08.10.2025 both parties were not represented.

On 25.11.2025, the respondent herein was represented but the petitioner herein did not take any steps. The Tribunal accordingly on being satisfied that notice has been issued, fixed the case for ex prate hearing on 02.01.2026.

On 01.01.2026 the petitioner company authorized a representative to pursue the case and annexure P-11 herein at page 69, being an application duly received by the opposite party, was submitted on 02.01.2026 by the petitioner herein praying for recalling the order dated 25.11.1015 fixing the matter for ex parte hearing and also permission to file written statement.

It appears from the subsequent orders that the said application has not been considered by the learned Tribunal. The next date is fixed (tomorrow) on 12.05.2026.

It is the contention of the petitioner on affidavit that on the next date 02.01.2026, the General Manager (Law) and Constituted Attorney of the petitioner company being duly authorized by the Executive Director(Works), Durgapur Steel Plant vide Letter of Authorization dated 01.01.2026 appeared along with an application dated 02.01.2026 praying for recalling of the order dated 25.11.2025 fixing the matter ex parte on the grounds stated therein.

Admittedly, the application for recalling the order of ex parte hearing and a prayer for filing written statement has not been considered by the learned Tribunal.

A copy of the application has already been served upon the respondent herein.

Accordingly, the writ application is disposed of with the liberty granted to the petitioner to file the said application before the Tribunal tomorrow, that is on 12.05.2026 and the parties herein shall appear before the learned Tribunal, who shall then consider the said application on hearing the parties and dispose of the same, in accordance with law, and then proceed with the hearing in the reference case.

Accordingly, the impugned orders dated 02.01.2026 and 02.03.2026 passed by the learned CGIT, Asansol, are hereby set aside.

The writ application stands disposed of.

Connected application, if any, stands disposed of.
