This revisional application was preferred challenging the proceedings of Case No. C-850 of 2006 under Section 406 of the Indian Penal Code then pending before the learned Metropolitan Magistrate, 15th Court, Calcutta. Records reflect that the interim order was lastly extended on 11.12.2007 which was for a period of one month after X-mas vacation. Thereafter there has been no progress in the hearing of this revisional application and the matter is pending before this Court. No information could be furnished before this Court regarding the present stage of the proceedings before the learned Metropolitan Magistrate. Having regard to the same, I direct that in case, the proceedings are pending before the learned Metropolitan Magistrate, 15th Court, Calcutta, in that case, the petitioners would be at liberty to agitate the points canvassed in this revisional application at the appropriate stage of the trial. With the aforesaid observations, the revisional application being CRR 1649 of 2007 is disposed of. Interim order, if any, is hereby vacated.

All pending connected applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
