1. Learned advocate appearing for the petitioner submits that the petitioner has been implicated on the basis of alleged recovery of 271 grams heroin and is in custody for a period of 1 year 9 months. Pursuant to the direction passed on 17th December, 2025, there is hardly any progress in the case and the prosecution intends to examine nine (09) witnesses in support of its case.

2. Learned advocate appearing for the State opposes the prayer for bail.

3. In have taken into account the chemical examiner's report also. Having regard to the quantum of seizure, the judgment of the Hon'ble Supreme Court in Sentu Seikh vs. State of West Bengal [SLP (Crl.) No. 13987 of 2025] and the period of detention of the present petitioner, I am inclined to release the petitioner on bail.

4. As such, the prayer for bail of the petitioner, namely, Safikul Gharami is allowed.

5. Accordingly, the petitioner shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Special Judge, NDPS Act, 12th Court at Alipore, South 24 Parganas.

6. If on bail, the petitioner shall be physically present before the learned Trial Court on each and every date. Petitioner shall not leave the district of South 24 Parganas without prior permission of the learned Special Court.

7. In the event, the petitioner fails to comply with any of the conditions as stated above, the learned Trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.

8. Accordingly, CRM (NDPS) 986 of 2026 is allowed.

9. All parties shall act in terms of the server copy of the order downloaded from the official website of this Court.

10. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
