The petitioner is aggrieved by the fact that there has been interference with the peaceful enjoyment of the property of the petitioner and to that effect, allegations have been made against the private respondents.

Learned advocate appearing for the private respondent nos. 4 and 11 submits that the private respondent nos. 4 and 11 are staying at a different State; in spite of the same, they have been implicated in a criminal case.

As none appears on behalf of the State, Ms. Bineeta Bhattacharjee, learned advocate, who ordinarily appears for the State, is directed to represent the State. Her appointment may be regularised by the concerned authorities.

Records reflect that a case has already been registered being Khejuri Police Station Case No. 381 of 2023 dated 06.06.2023.

Having considered that the police authorities have already taken steps in respect of the complaint so made and no information has been furnished to this Court regarding further progress of the investigation, I am of the view that at this belated stage, it may not be fit and proper to pass necessary specific direction. Having considered the nature of the dispute and the fact that the criminal court is already in seisin of the issue since June, 2023 and more than two years have passed, I direct the petitioner to canvass his grievance, if there is any violation of law and inconveniences faced by him. No specific direction is called for by this Court at this belated stage. Petitioner would be at liberty to approach the jurisdictional court.

With the aforesaid observations, the writ petition being WPA 11479 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
