Assigned The petitioner is an employee of the West Bengal State Electricity Distribution Company Limited. He is aggrieved by the transfer order dated 8th January, 2021 whereby he has been transferred from Akandaberia, 33/11, KV Sub-Station under Tehatta Division to Ajodhya CCC under Uluberia Division.

According to the petitioner his place of transfer is very far from his residence and it will be very inconvenient for him to join the transferred place of posting.

Be it mentioned that the said order of transfer was passed or an application made by the petitioner for mutual transfer whereby the petitioner sought to get himself transferred from Akandaberia, Nadia to

Nabghara, Howrah and the private respondent herein sought transfer from Nabghara Howrah Sub-Division to Akandaberia, Nadia Sub-Division. But at the time of passing the order of transfer, the private respondent has been posted at Nabghara whereas the petitioner has been transferred to Ajodhya as Ajodhya was the original place of posting of the private respondent. The petitioner has forwarded a list of SubStations in and around Howrah where, according to the petitioner, there are vacancies.

The learned advocate representing the employer submits that there are no vacancies in the SubStations, pointed out by the petitioner. As it is for the employer to decide as to where an employee is to be posted, accordingly, the petitioner may approach the employer with his prayer for posting. In the event such an application is made within a week from date, the same shall be considered and disposed of in accordance with the service rules and regulations of the Company within a fortnight thereafter. The employer shall intimate the fate of his application to the petitioner immediately thereafter. W.P.A. 11101 of 2021 stands disposed of.
